The ACLU of Idaho opposes IDOC rule 06.01.01 that grants the IDOC director discretion to withhold public records from disclosure regarding information related to executions. This proposed rule flies in the face of an Idaho court’s decision in the Cover v. Board of Correction lawsuit that ruled the Public Records Act does not grant IDOC discretion to withhold public records on its own accord, as this new rule would allow. Instead, this rule jeopardizes government transparency and attempts to cloak the Department’s actions regarding executions in secrecy.
